When you contact KB Premium Designs you are communicating with us electronically. You consent to receive communications from us electronically. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Licence 
You do not have permission to utilise sections or the entirety of this website through iframes or printed media without express written consent of KB Premium Designs. 
 
Your Account 
If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. 
 
Reviews and comments 
KB Premium Designs encourages customer reviews and comments and by submitting them you are authorising their use in this website and other media, royalty free. 
 
You may not use a false email address with the intention to impersonate others or mislead. 
 
Risk of loss 
All items purchased from KB Premium Designs are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier. 
 
Product descriptions and Images 
KB Premium Designs aims to provide accurate product information and as true to life images as possible although restrictions of the internet and screen resolutions mean it is not always possible to see the true colour of any item. 
 
Pricing 
All prices quoted in this website are inclusive of VAT and a flat fee delivery charge will be added on all orders under £50. For the sake of clarity, when using discount tokens the full value of the order, including discount would need to total £50 or over to receive free shipping. For all wedding orders FREE shipping is granted on orders over the value of £300. 
 
Invoicing  
 
KB Premium Designs will invoice via Xero accountancy software. Once we have received your booking form or enquiry, we will email you your invoice/s. If it is not possible to obtain full payment from you within the agreed time frame, then we are within our rights to refuse to process your order/service and/or suspend any further orders/services to you. This does not affect any other rights we may have.

- Services 
For workshops/classes of larger group bookings, we invoice for 50% of 6 participants to be paid within 5 working days. Remaining payment 14 days prior to date of booking.  
If you are booking a class/workshop via our online shop, this payment is immediate. If your enquiry is within 2 weeks of your booking date, full payment will be required. 
Womens Institutues; ladies groups, society or any type of organisation will vary within their payment terms due to the "type" of services booked and this will be discussed via email with said organisation.  
 
- Wholesale 
For large product orders for retail you will be invoiced a 50% deposit payment to be paid within 7 days. Remaining amount will be due 14 days before the agreed shipment date.  
 
- Travel 
Any travel expense occurred for services provided will be added to the invoice. This is charged at 45p per mile. The first 15 miles of travel are free. Any miles in excess of this will be accurately stated on your invoice. We use google maps to gain mileage information.  
 
Services and workshops agreement 
 
Any service or class booked will have an agreement in writing via emial or via the booking system.  
 
 
DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY 
This website is owned and operated by KB Premium Designs and you use this website at your own risk. Due to the nature of the internet and electronic communications KB Premium Designs does not guarantee that use of this website or emails are free from viruses and therefore cannot be liable for any damages arising from the use of this site or email correspondence to and from KB Premium Designs.

Terms of service T&C's 
 
 
 
 
1. Definitions 
 
In this document the following words shall have the following meanings: 
 
1.1 CUSTOMER means any individual, partnership, limited company, charity or organisation that from time to time purchases Services from the Supplier. 
 
1.2 SUPPLIER means KB Premium Designs of 3 Foundry Walk, Thrapston, Kettering, NN14 4LS 
 
1.3 PROPOSAL means a statement of work, quotation, confirmation or other similar document describing the services to be provided by the Supplier. 
 
1.4 SERVICES means the services specified in the proposal. 
 
1.5 The CONTRACT shall mean instructions, confirmed in writing or electronic format, issued and agreed by the customer or an authorised person on behalf of the customer. 
 
1.6 FEES shall mean all charges and expenses that will by invoiced by the Supplier to the customer for the services provided. 
 
1.7 TERMS AND CONDITIONS means the terms and conditions of supply set out in this document and any special terms and conditions agreed in writing by the Supplier. 
 
 
 
2. General 
 
2.1 These Terms and Conditions shall apply to all contracts for the supply of Services by the Supplier to the Customer and shall prevail over any other documentation or communication by the Customer. 
 
2.2 Any variation to these Terms and conditions shall be inapplicable unless agreed in writing by the Supplier. 
 
2.3 Nothing in these Terms and Conditions shall prejudice any condition or warranty, express or implied, or any legal remedy to which the Supplier may be entitled in relation to the Services, by virtue of any statute law or regulation. 
 
2.4 Nothing in these Terms and conditions shall affect the customer’s statutory rights as a consumer. 
 
 
 
3. The Service 
 
3.1 The service proposal agreed that link to these Terms and Conditions shall remain valid at all times. 
 
3.2 The Customer shall be deemed to have accepted the service proposal by placing an order with the supplier within the period specified in Clause 3.1 
 
3.3 KB Premium Designs will not commence work until the customer has accepted these Terms and Conditions as well as the instructions including, but not limited to, a proposed timeline and an estimate of fees which will be set out in an accompanying proposal. 
 
3.4 The service proposal will be the best estimation of time required to meet your needs. If further time is required you will be consulted before any further activity takes place. 
 
3.5 The Supplier shall not be liable for failure to complete the work within the proposed timeline. 
 
 
 
4. Fees 
 
4.1 The fee for the Service is as specified in the service proposal and outlined expenses. 
 
4.2 Fees are based on the Supplier’s current assessment of costs and are subject to amendment subject to clause 12 – Cancellation and Termination. 
 
4.3 Payment of the fee shall be in the manner specified in the Proposal - we take a non refundable 50% deposit for 6 participants to secure the date and time of your booking, and the remaining balance will be due 2 weeks prior to your booking date. 
 
4.4 If your enquiry is within 2 weeks of your booking date, full payment will be required. 
 
4.5 If you are adding more participants to your booking and this exceeds the maximum agreed, we need to be informed 7 days prior to the date of the event.  
 
 
 
5. Completion And Payment Of Fees. 
 
5.1 Completion of the work shall be deemed to have taken place when such work as described in the proposal has been carried out. At this stage full payment of the fee would of been settled as stated in 4.3, 4.4 and 4.5 
 
5.2 Should the proposal be delayed or cancelled within 28 days of the booking date at the request of or through and default of the client, KB Premium Designs shall be entitled to retain the payment of the fees until the client has rearranged another booking date. 
 
5.3 Payment terms for deposits are 5 working days from the date of the invoice, unless agreed beforehand. 
 
5.4 Payment terms for the remaining balance are 14 days prior to the booking date, unless agreed beforehand. 
 
5.5 Payment terms for society's and organisations of regular group meets will be discussed via email.  
 
5.6 If the Customer fails to make any payment within 2 weeks of the booking date, their booking is therefore classed as not secure and that date may be redeemed by another customer. 
 
5.7 If on the booking day additional extras are requested, this will be at the discretion of the supplier as to whether they can meet the customer demand, if so, another invoice shall be sent and requires payment upon receipt of receiving the invoice. 
 
 
 
6. Customer Obligations 
 
To enable KB Premium Designs to perform its obligations the Customer shall: 
 
6.1 Keep to the agreed booking date and time as set in the proposal. 
 
6.2 Provide the supplier with any information reasonably required by the Supplier including any relevant medical/dietary information for all guests attending the booking, the supplier will not take responsibility for allergies (including skin, food, materials etc) where they are not advised in advance of the condition. 
 
6.3 Obtain all necessary permissions and consent which will be required before the commencement of the services, the cost of which is the sole responsibility of the Customer. 
 
6.4 Comply with such other requirements as may be set out in the Proposal or otherwise agreed between the parties. 
 
6.5 Be the responsible person for the welfare of the children at the classes/workshop/parties and that they are supervised at all times. 
 
6.6 The customer is responsible for confirming numbers and choices at least 14 days prior to the booking date, any booking reductions within the 14 days prior to the booking date will still be charged for the previous rate with no refunds due. 
 
 
 
7. KB Premium Designs Obligations 
 
7.1 The Supplier shall perform the Services with reasonable skills and care and to a reasonable standard. 
 
7.2 The Supplier accepts all responsibility to fulfil the service that is within its’ control, on the agreed booking date and to a satisfactory standard. 
 
7.3 KB Premium Designs are committed to the following service standards; 
 
- All information supplied by the supplier to the customer will be impartial. 
 
-The supplier will provide understandable information that will enable an individual to make their party/group booking. 
 
-Identified cultural priorities will be respected. 
 
-Individual and diverse needs will be embraced. 
 
-All associates working with the supplier will be vetted and checked for suitability through the Disclosure and Barring Service. 
 
-All Associates working with the supplier will have relevant qualifications, skills and experience.  
 
-Following each intervention we will seek customer feedback/details to continually monitor and improve our service. 
 
 
 
8. Travel  
 
8.1 The period of paid travel by the Customer shall commence after 15 miles from the Suppliers registered trading address. The bookings location/destination to and from, will be retrieved via Google Maps to ensure the mileage is calculated and recorded accurately. This will be added to your invoice with full description of travel.  
 
8.2 The fee for mileage is 45p per mile under the government approved mileage rate.  
 
 
 
9. Confidentiality & Data Protection 
 
9.1 Information disclosed by the customer will be kept confidential and shared only with relevant staff providing the service as agreed. 
 
9.2 All information retained by KB Premium Designs will be solely for the purposes of fulfilling the contract. 
 
9.3 The Supplier will not transmit any personal data held on behalf of the client except where a) The transfer is a necessary part of the work undertaken to fulfil the booking or b) There is a requirement to do so by operation of the law. For example, if there is a situation where concerns are raised regarding the safety and well-being of the customer. 
 
 
 
10. Complaints And Disputes 
 
10.1 The supplier will always aim to deliver excellence however there may be times when the customer is not happy with the service provided by the supplier and you shall be able to email the supplier to go through the complaints procedure 
 
10.2 If there is a dispute about the interpretation or operation of your booking then the supplier will make every effort to resolve the dispute when and where it arises, negotiating on the basis of good faith 
 
 
 
11. Limitation Of Liability 
 
11.1 KB Premium Designs maintains Public Liability Insurance with Simply Business to £5,000,000 for each and every claim 
 
11.2 KB Premium Designs maintains Public and Products Liability Insurance. 
 
11.3 The Supplier will not be held responsible for third party costs incurred by the customer for any reason whatsoever. 
 
11.4 Nothing in these terms shall limit or exclude the liability of KB Premium Designs which may not be limited or excluded by law, including without limitation liability for death or personal injury caused by KB Premium Designs negligence or fraudulent misrepresentation. 
 
 
 
12. Cancellations & Termination 
 
12.1 The customer may cancel the Service by notifying KB Premium Designs via email: sales@kbpremiumdesigns.co.uk giving a minimum of 28 days’ notice. 
 
12.2 Cancellation of a booking less than 28 clear days notice prior to the booking date will receive no refund or it will be at KB Premium Designs discretion. 
 
12.3 In the result of you receiving a refund, please note your deposit is non-refundable. 
 
12.4 If you wish to re-scheldule your date before the 28 clear day period this will be honoured with received funds not affected.  
 
12.5 If you wish to re-schedule less than 28 clear days notice prior to your booking date the deposit will not be honoured and you will be sent a new invoice for this amount at the discretion of KB Premium Designs.  
 
12.6 KB Premium Designs may terminate the Service for any good reason at any time giving written notice, namely email, or a phone call to the customer. 
 
12.7 In the result of KB Premium Designs cancelling a booking, a full refund will be issued to the customer with immediate effect. 
 
12.8 KB Premium Designs will not be liable to pay any compensation to the customer or any other person for any loss, damage or expenditure arising directly or indirectly from the cancellation and will offer an alternative date.  
 
12.9 KB Premium Designs reserves the right to terminate the booking without notice if there is a breach of these conditions.

14. Force Majeure 
 
Neither party shall be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the party shall be entitled to a reasonable extension of its obligations. 
 
 
 
15. Severance 
 
If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid, illegal or unenforceable provision eliminated. 
 
 
 
16. Governing Law And Jurisdiction 
 
Any disputes or claims arising out of or in connection with these Terms and conditions of Business or the contract shall be governed by and construed in accordance with the law of England and Wales 
 
 
 
17. Acceptable Of Terms 
 
By accepting your booking quote and paying the deposit for the service proposal you will be accepting the Terms and Conditions of Business.
